The International Swaps and Derivatives Association (ISDA) and the Futures and Options Association (FOA) have published the ISDA/FOA EMIR Reporting Delegation Agreement. This document is intended to help market participants meet their reporting obligations by providing a bilateral standard form of reporting delegation agreement whereby a Reporting Delegate may, on the Client’s behalf, report relevant data to a trade repository or ESMA. In August 2013, ISDA published the 2013 EMIR Portfolio Reconciliation, Dispute Resolution and Disclosure Standard Amendment Agreement (Amendment Agreement). The Amendment Agreement relates only to ISDA Master Agreements but may be amended to cover other agreements. It is available from the ISDA website. ISDA had previously published the 2013 EMIR Portfolio Reconciliation, Dispute Resolution and Disclosure Protocol and related documents in July 2013, which can be used to amend the ISDA Master Agreement and other agreements governing derivatives transactions.
