The Minister for Health has published the Health Insurance (Miscellaneous Provisions) Bill 2008 which provides for the amendment of the existing health insurance and tax legislation to ensure that access to health insurance cover is available without differentiation made in respect of age and health status. The Bill address issues arising from the decision of the Supreme Court in Bupa Ireland Limited & anor -v- Health Insurance Authority & ors [2008] IESC 42.

The stated purpose of the Bill is to ensure that the burden of the costs of health services are shared by insured persons. The Bill provides for a cost subsidy between young and old in respect of health insurance.
