In our November 2009 update, we included a reminder to trustees and employers of occupational pension schemes that from 6 April 2010, a new minimum normal pension age of 55 will apply. HMRC has now published its Pension Schemes Newsletter 38 in which it sets out its guidance for the interpretation of rules relating to the payment of pensions and pension commencement lump sums from 6 April 2010. It has also included some examples of potentially difficult practical situations where members reach age 50 or 55 around the date of change in the law.
