The final tranche of reforms to the EU trade mark system will enter into force on 1 October 2017 (see our blog series for discussion of the reforms that took effect from March 2016).

Most of the changes coming in now are procedural, but some of the more substantial changes are:

  • the change to the graphical representation requirement which in theory makes non-traditional marks easier to register; and
  • the availability of EU Certification Marks.
