Formal notice has been given in the Federal Register of the FCC’s October 12, 2012 order repealing the rule prohibiting cable operators from encrypting the basic tier of service.The publication of this notice establishes December 10, 2012 as the effective date of the repeal of the encryption prohibition.

Clients are advised that before encrypting the basic tier, they must give at least 30 days advance notice to subscribers, using specific language found in the FCC’s order.
