The Office of Fair Trading (OFT) has provisionally found that Tesco, ASDA, Sainsbury’s, Safeway and Morrisons colluded between themselves and several dairy companies (Arla, Dairy Crest, Lactalis McLelland, The Cheese Company and Wiseman) to keep the price of certain products artificially high. A three pence increase in the price of milk is alleged to have cost consumers an estimated £270m. Collusive price fixing behaviour is prohibited under both Chapter 1 of the Competition Act 1998 and Article 81 of the EC Treaty. The supermarkets and dairies now have the opportunity to respond to the OFT before it issues a final decision. The OFT has the power to fine companies found to have breached competition law.
