JMW Farms Ltd was fined £187.5k in July 2012 after pleading guilty to a charge of Corporate Manslaughter. On 15 November 2010 JMW’s employee, Mr Wilson, was struck by a metal bin which fell from the raised forks of a forklift being driven by one of the company’s directors, Mark Wright. The bin had not been properly attached to the forks, and when the vehicle reversed the bin was able to fall onto Mr Wilson, causing fatal head injuries.
A joint investigation by the Health and Safety Executive in Northern Ireland and the Police Service of Northern Ireland found a number of failings, which included the forks being too large for the bins and being incorrectly spaced. The forklift itself was an on-loan replacement whilst the routine vehicle was being serviced.
