• The decision in Attrill v Dresdner Kleinwort, regarding a claim made by 104 bankers to a “guaranteed” bonus pool of €400m, is to be heard by the Court of Appeal next year – permission to appeal was given on 6 November.  Our summary of the High Court ruling is available here.
  • The Societe Generale, London Branch v Geys case, concerning the circumstances in which an employer can rely on a clause entitling it to terminate an employment contract by making a payment in lieu of notice, was heard in the Supreme Court on 18-19 October  – judgment is expected in early 2013.
  • It has been reported in media that JP Morgan has filed a claim against Javier Martin-Artajo, the former boss of Bruno-Iksil, nicknamed the “London Whale” by the press, in respect of $6.2bn lost in unauthorised trades. The exact details of the JP Morgan claim has not yet been made public, but we understand that the case relates to the issue of bonus claw-backs.
