In 2003, Technologie Buczek, a Polish tube producer, was given around €4 million as part of a national restructuring programme for the Polish steel industry. The restructuring plan was not successfully implemented and, in 2006, the company filed for bankruptcy. As a result, the Commission has found that €350,000 of the aid was misused and should be recovered by the Polish Government. The Polish Government will also be required to recover outstanding debts owed by Technologie Buczek. The Commission found that despite securities against which the Polish authorities could enforce the debt, it failed to do so. A private creditor in a similar position would have relied on the securities to fulfil the debt. This deferral of payments therefore also amounts to State aid and Technologie Buczek is required to repay over €5.35 million in total.
