On 13 September, the Competition Appeal Tribunal (“CAT”) rejected Ryanair’s application for permission to appeal against the CAT’s decision of 28 July 2011. The CAT’s July decision had found that the OFT’s investigation into the Ryanair/Aer Lingus merger was not time-barred despite being conducted outside of the four month statutory period because the OFT had been unable to act while appeals were going through the European Courts.
