The FSA has censured a mortgage broker for failing to ensure the suitability of his mortgage recommendations in breach of Principle 9. In particular, the mortgage broker failed to ensure that affordability, needs and circumstances of customers were fully taken into account when making recommendations, or record how or why a recommendation was made. The censure was given on the basis that the mortgage broker agreed to withdraw his Part IV permissions so that he could no longer carry on any regulated mortgage business and undertake remedial action, in the form of a past business review.
