On March 25th, Reuters reported a SEC enforcement attorney has been questioned by a federal district court judge concerning a SEC press release which may have violated local court rules. The March 18, 2013 press release announced an asset freeze against a Massachusetts-based investment adviser charged with stealing money from clients. The defendant in the SEC enforcement action, Gregg D. Caplitz, is also a defendant in an unrelated criminal tax case. Under the local rules for the U.S. District Court for Massachusetts, lawyers are prohibited from making extra-judicial, public comments that could prejudice a jury pool.
