In a significant decision dated February 6, 2013 (no. 11-23.738), the Supreme Court reversed its prior case law precedent by holding that the flat payment of 6 months’ pay in case of undeclared work can now be cumulated with all severance payments of any type to which an employee is entitled in case of the termination of his employment, including the dismissal payment that was previously not owed. This solution, which is legally logical, could well have significant financial repercussions.
