On Aug. 25, 2009, the Illinois Limited Liability Company Act was amended to require Illinois LLCs providing professional medical services to register with the Illinois Department of Financial and Professional Regulation (IDFPR), as professional corporations and medical corporations have been doing for years. Although this section of the Act was enacted in 2009, it was not implemented until recently.
On Jan. 14, 2011, however, the IDFPR issued a press release requiring immediate registration. Moreover, prior to this month, the IDFPR did not have a mechanism in place for LLC registration. The IDFPR now requires LLCs providing professional medical services (and dental services) to register within 90 days. LLCs that do not comply with the registration may be subject to enforcement by the IDFPR. The IDFPR states that it will begin enforcement for failure to register after 90 days.
