The decision by four municipalities in North Rhine-Westphalia to transfer waste disposal services to a special purpose vehicle established by them does not amount to an award of a public service contract. This was the view reached by the European Commission when it decided to close an investigation into a complaint against the German government on 21 March 2007. The Commission considered that the complete transfer of a public task from one enterprise to another, to be performed entirely independently by the transferee at its own responsibility, is a matter of public administration and is not subject to the EU rules on free movement.
