Medion Australia Pty Limited (Medion), a supplier of pre-paid mobile products and services, has given an enforceable undertaking to the ACCC after admitting that it is likely to have engaged in misleading conduct, and made false or misleading representations in relation to its "Unlimited Pack". Medion operates the ALDImobile website and represented on the website that the "Unlimited Pack" offered 30 days of unlimited voice calls, voicemail, SMS and MMS, when it was actually subject to usage restrictions set out in the Acceptable Use Policy. Medion is not a related entity of ALDI Stores.
The undertaking requires Medion to refrain from engaging in similar conduct for three years, publish a corrective notice on the website, and establish a competition and consumer law compliance program for two years. Medion has now changed the name of the "Unlimited Pack" and removed the description of "unlimited" from online and in-store advertising.
