Employment Appeals Tribunal (24 February 2009): The EAT upheld a tribunal's decision that no service provision change had occurred and there was therefore no relevant transfer for the purposes of regulation 3(1)(b) of TUPE, when a contract was re-assigned from an original contractor to several new contractors.

On the facts of this case, after the re-assignment from the original contractor, the activities previously carried out by the original contractor were so fragmented, that it was no longer possible to determine to which new contractor they transferred.
