York Magistrates Court in the UK have prosecuted a gentleman who took a selfie during his friend’s court appearance. The photograph, which captured all those in attendance and involved in the trial, was subsequently uploaded onto his personal Facebook page.
The gentleman was arrested for two offences under Section 41 of the UK Criminal Justice Act 1925:
- under Section 42(1)(a), the offence of taking a photograph in court of any person, being a judge of the court or a juror or a witness in or a party to any proceedings before the court.; and
- under Section 42(1)(b) for the publication of such photograph, in this case on his Facebook page.
The gentleman received an £85 fine, £85 in costs and a statutory surcharge of £20.
