Our alert of 27 November set out the recently published revised thresholds that will apply to procurements under the new (2014) Procurement Directives from 1 January 2016 (which are slightly higher than the current thresholds in euro terms, though slightly lower under the new corresponding UK sterling values published at the same time). They will apply to procurements conducted under the Public Contracts Regulations 2015, from 1 January 2016.
At the time of our alert the Commission did not announce any changes to the thresholds relevant to the old (2004) Directives. However, following conversations with the European Commission, we understand that it is revising the thresholds for the old Directives, to align them with the revised thresholds for the new Directives. We expect them to be published shortly (possibly next week) and to come into effect on 1 January 2016.
We shall confirm the position once the revised thresholds are published but, based on our understanding, the new aligned thresholds will apply to procurements under the Utilities Contracts Regulations 2006 from 1 January (and that, for practical purposes, there will be no further change in the relevant thresholds on implementation of the Utilities Contracts Directive 2014, expected in early April 2016).
