CMS has delayed implementation of the new "stand in the shoes" provision contained in the Phase III Final Stark regulations until December 4, 2008, for academic medical centers and nonprofit health centers. Pursuant to the provision, physicians will stand in the shoes of their physician organization for the purpose of determining whether a direct or indirect financial relationship exists. Citing potential issues arising with respect to commonly paid support payments within academic medical centers, CMS agreed to a one-year delay in implementation of the provision for arrangements at academic medical centers and integrated nonprofit health care systems. The notice of delay will be published in the November 15th Federal Register.
