The Merchant Shipping (Implementation of Ship-Source Pollution Directive) Regulations 2009 (2009/1210) come into force on the 1st of July 2009. The Regulations give effect to EC Directive 2005/35 on ship source pollution and on penalties for infringement. The Regulations will amend the Merchant Shipping Act 1995, the Merchant Shipping (Prevention of Oil Pollution) Regulations 1996 (SI 1996/2154) and the Merchant Shipping (Dangerous or Noxious Substances in Bulk) Regulations 1996 (SI 1996/3010). The Regulations amend s131 of the Merchant Shipping Act 1995 so that all discharges in UK territorial waters will be covered by the 1996 Regulations. The penalties in the 1996 Regulations have been extended. The term “serious negligence” used in the Regulation has been introduced.
