Effective January 26, 2009, all EB-5 related filings will be handled by the USCIS California Service Center. The fifth employment-based immigrant visa preference category, EB-5, provides visa numbers for immigrant investors seeking to pursue permanent residency in the United States.
EB-5 related filings include the following:
- Regional Center Proposals;
- Form I-526, Immigrant Petition by Alien Entrepreneur;
- Form I-829, Petition by Entrepreneur to Remove Conditions; and
- Form I-485, Application to Adjust to Permanent Resident Status (only those based on an approved I-526).
The USCIS Texas Service Center will no longer accept EB-5 related filings. All forms and proposals currently pending with the USCIS Texas Service Center will be transferred to the USCIS California Service Center for adjudication.
