Amazon obtained a summary judgement win in a patent infringement suit brought by Virginia Innovation Sciences in the Eastern District of Virginia. The case asserted 11 patents and targeted three different types of products.
As previously reported, in January 2017 Amazon argued that eight out of 11 asserted patents were invalid under 35 U.S.C. 101 and the U.S. Supreme Court's decision in Alice Corp. Pty. v. CLS Bank International and its progeny. The court granted that motion, leaving only three patents remaining. This fall, the parties filed cross-motions for summary judgment on the remaining patents. The court issued its order, granting Amazon’s motion for summary judgment and denying VIS’s motion in its entirety.
