Food for special medical purposes (FSMP) is regulated under Regulation 609/2013 known as the Regulation on Food for Specific Groups and the Commission Delegated Regulation 2016/128 which specifies compositional and information requirements for this category of food. Following the increasing difficulties with the enforcement of the applicable framework reported by national authorities of Member States, the European Commission has published on 25 November 2017 the Notice on the classification of Food for Special Medical Purposes. The objective of the Notice is to assist national authorities in the enforcement duties and businesses in marketing their products appropriately and complying with the EU requirements. The Notice brings more clarification on different elements of the definition of FSMP, classification of FSMP in categories and data needed for correct placement of a product as FSMP on the market.
