On 11 March 2009 the Scottish Parliament passed the Damages (Asbestos-related Conditions) (Scotland) Bill. This Bill effectively overturns the decision of the House of Lords in 2007 in the case of Rothwell where it was held that people diagnosed with asbestos related pleural plaques should not be eligible for compensation. In the meantime, the outcome of the consultation being carried out by the Ministry of Justice in England and Wales is awaited.
