On 6 March 2014, David Green, Director of the SFO, made a speech setting out the SFO’s view of its role as a prosecuting authority. In the speech, David Green made it clear that the SFO is not “a regulator, an educator, an advisor, a confessor, or an apologist”. Instead, with the advent of the new Deferred Prosecution Agreements (DPAs), David Green reiterated the SFO’s role as a law enforcement agency with no responsibility to provide guidance on ethical standards to corporate organisations. That said, the speech contains some useful insights into the approach of the SFO to the new DPAs and what the SFO will expect of organisations seeking disposal by way of DPA.
