Axa, together with Aviva, RSA and Zurich, failed in their challenge to the Damages (Asbestos-related Conditions) (Scotland) Act 2009 which makes pleural plaques an actionable injury in Scotland, reversing the effect of the House of Lords’ decision in Rothwell v Chemical and Insulating Co Ltd. They are apparently intending to appeal the decision. Renewed calls have been made for the government to introduce similar legislation to permit claims to be brought in England and Wales (Axa General Insurance Ltd v Lord Advocate Outer House, Court of Session http://www.bailii.org/scot/cases/ScotCS/2010/2010CSOH02.html).
