In the recent English Court of Appeal judgment in Fiona Trust & Holdings Corporation & ors v Yuri Privalov & Ors [2007] EWCA Civ 20, an arbitration clause was enforced notwithstanding the fact that a party to the contract had purported to rescind the contract following bribery allegations. It was held that if the contract was said to be invalid for reasons such as bribery, unless the bribery relates specifically to the arbitration clause, the clause survives and the validity of the contract as a whole is determined by the arbitrators, not the court.
