Section 535(a) of Division F of the Consolidated Appropriations Act (2004), which authorized an exception to the Buy American Act for the acquisition of information technology that are commercial items, has been implemented by the Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council through the issuance of Federal Acquisition Circular 2005-13. The final rule amends Federal Acquisition Regulation 25.103 and Subpart 25.11 and applies to all solicitations for commercial technology where the Buy American Act previously applied. As a result of the new regulations, commercial IT products will be evaluated without regard to country of origin for purchases between the micro-purchase threshold and $193,000. The Trade Agreements Act still applies to commercial IT procurements.
