The EDPS'S opinion on EMIR dated 19 April 2011 has been published in the Official Journal of the EU (OJ). The opinion, based on the Commission's September 2010 legislative proposal for EMIR, analyses the position regarding data protection and ESMA's power to "require records of telephone and data traffic". The EDPS believes that "the power to require records of telephone and data traffic should be limited to what is appropriate to achieve the objective pursued" and the legislative proposal is "too broadly formulated".
