The Competition Commission issued a notice of apparent breach against Sibanye Gold Ltd (Sibanye) for failing to comply with conditions attached to a merger approved earlier this year. The conditions placed a two-year moratorium on any merger-related retrenchments. The National Union of Mineworkers filed a complaint with the Commission alleging that Sibanye had breached this condition. Following an investigation, the Commission found that employees at Sibanye had been retrenched and that this was directly as a result of duplication of work which arose from the merger.
