On 12 November 2013, the ACCC instituted proceedings against Fisher & Paykel Customer Services Pty Ltd, and its related body corporate, Domestic & General Services Pty Ltd, alleging misleading or deceptive conduct, and false or misleading representations in the course of offering an extended warranty. 

The ACCC alleges that the respondents misled consumers about their statutory consumer guarantee rights under the Australian Consumer Law, as the consumers’ contractual rights under the proposed extended warranty plans were wholly or partly equivalent to the rights available under the statutory guarantees regime.

The ACCC is also claiming the respondents breached their obligations under the Australian Securities and Investments Commission Act 2001.
