On 15 August 2009, two appeals were lodged at the Court of First Instance (CFI) against separate instances of refusal by the European Commission (Commission) to disclose documentation. Two fuel companies, Shell Hellas and Société des Pétroles Shell (SPS), asked the Commission to provide them with copies of correspondence which related to inquiries by the Greek and French national competition authorities into alleged anti-competitive conduct in the local market for jet fuel. The documentation was originally sent to the Commission by the national competition authorities in compliance with EU competition rules which provide for the exchange of information about investigations of breaches of EU competition rules. The companies appealed against the Commission's implied decision to refuse access. The grounds were that the Commission had not provided adequate reasons for the refusal or carried out a proper assessment as to whether part of some of the documentation should have been disclosed.
