In September 2012, the Presidium of the Supreme Commercial Court of the Russian Federation (the “SCC”) reviewed the matter of administrative liability for placing a trademark owned by others on shipping documents.

It is worth noting that the ruling of the SCC, which has consistently supported the positions of the customs authorities and right holders in disputes when unauthorised importers have infringed upon the formers’ rights, could result in new disputes involving the unlawful use of trademarks, particularly on shipping documents.
