The court gave guidance on the interrelationship between CPR 47.8, which deals with failure to commence detailed assessment proceedings in time, and CPR 44.14, which concerns the discretion as to costs. Where there is no wilful misconduct, no prejudice is caused to the other party and the delay is excusable, the sanction in CPR 47.8 of loss of interest on costs is sufficient and costs should not also be disallowed under CPR 44.14.
