LabMD’s efforts to limit the Federal Trade Commission's authority to regulate cybersecurity have hit a roadblock on the administrative road. As we have reported, the company, which conducts clinical lab tests, is challenging the FTC’s authority before both the FTC and the U.S. District Court for the District of Columbia, after the agency brought an enforcement action against the company alleging poor data security practices. LabMD is the second company (after Wyndham Hotels) to challenge the FTC's authority on cybersecurity. Last month, the Commission rejected LabMD’s motion to dismiss the complaint. The court case is still pending, with the FTC expected to file a response to LabMD’s arguments later this month.
