The Philippine Anti-Age Discrimination Act came into force in 2016. Under the new law, it is unlawful for an employer to:
- Publish any employment advertisement suggesting preference and discrimination based on age;
- Require the declaration of age or date of birth during the application process; and
- Discriminate an individual by offering different compensation and/or terms of employment on account of his/ her age.
Companies will be liable for fines and/or imprisonment if found to have violated the Act. We anticipate the Department Of Labor and Employment will issue and implement further rules and regulations under this new law in 2017.
