TUPE has been amended so that where a transfer takes place on or after 1 May 2014, employee liability information must be provided at least 28 days before the transfer. Previously the deadline was 14 days before the transfer.

Prospective transferees will likely see the change as positive. The scope of information remains the same, as it was felt that any change would be too burdensome for transferors. Parties may still wish to agree contractually what additional information should be provided, and the deadline for doing so, if information is required more than 28 days before the transfer.
