Law nr. 63/2013 was published today in the Portuguese official gazette. The present Law establishes mechanisms to combat the misuse of the independent services contract in the subordinated employment relations, among which we highlight:

  • Amendment to the applicable procedure for labor and social security misde-meanors through:
    • introduction of Article 15. º-A of Law nr. 107/2009, of September 14 lay-ing down the procedure to be adopted in case of misuse of the independent services agreement;
    • assignment of jurisdiction to the Authority for Working Conditions to ini-tiate the procedure laid down in Article 15. º-A of Law nr. 107/2009, of September 14.
  • Amendment to the Code of Labour Procedure with:
    • Establishment of an urgent and simplified lawsuit for recognition of the existence of an employment agreement, which sentence acknowledging the existence of an employment relation defines the starting date of such employment relation.
