In (1) Andrew Stephen Reid (formerly T/A Reid Minty) (2) RMPI LLP (Company No.Oc307073 formerly Reid Minty LLP) v (1) Simon Peter Edwards (2) Mark O'Shaughnessy (3) Derek Thompson (4) Prolegal Ltd (5) Capita Group Plc [2008] EWHC 2722 the Chancery Court considered the circumstances in which a trial, fixed for January 2009 could be adjourned on the grounds that the Claimant had had a recent accident and so could not prepare for the trial and that the two actions be tried together. It was held that the trial should not be adjourned on medical grounds. The judgment considers the circumstances in which concurrent trials should be ordered and the interaction between concurrency and the application to vacate the trial date.
