On August 24, 2012, the Commission issued a Notice of its decision to affirm the ALJ’s finding of no violation as to U.S. Patent Nos. 5,636,223 and 6,272,333 patents and to reverse the finding of violation as to U.S. Patent No. 6,246,697 in Inv. No. 337-TA-745, Certain Wireless Communication Devices, Portable Music and Data Processing Devices, Computers and Components Thereof, involving Complainant Motorola Mobility and Respondent Apple. The Commission also determined to remand the investigation to the ALJ with respect to 6,246,862. The Commission reversed the ALJ’s finding of a violation as to the ’697 patent because the accused products did not meet the limitations of the asserted claims. The Commission reversed the finding of no violation as to the ’862 patent, finding that the asserted claims were not indefinite. On remand the ALJ must make findings regarding infringement, alidity, and domestic industry.
