The Legislative Yuan passed the amendment to the Intellectual Property Case Adjudication Act on May 20, 2014. Major amendments include: (1) To strengthen the protection of trade secrets: in cases of infringement of trade secrets, when the plaintiff has clearly explained the facts underlying its allegations of trade secret infringement, the court shall compel a defendant to provide a concrete defense as to the reasons for its denial of infringement; otherwise the court may, depending on an examination of the circumstances, deem the plaintiff’s allegations as fact. (2) To broaden the scope of the official duties of a technical examination officer: the amendment also provides that the court may, whenever necessary, order a technical examination officer to provide assistance with respect to procedures for injunctions or enforcement.
