The IP Court sustained the TIPO’s rulings on the trademark opposition petition in a judgment issued on September 25, 2014, where the Court held that the appearance of the trademark “W (STYLIZED)” designated on products of Class 25, i.e., clothing, hats, etc., was similar to the simple letter “W”, and that the “W (STYLIZED)” trademark has not been used broadly on the designated products and thus lacks distinctiveness.  As such, the registration thereof should be revoked.
