The Pipeline and Hazardous Materials Safety Administration issued a final rule on April 17, 2013, revising maximum and minimum civil penalties for violations of hazardous material transportation rules. 78 Fed. Reg. 22,798 (4/17/13). Titled “Hazardous Materials: Revision of Maximum and Minimum Civil Penalties,” the revisions conform the rules to the “Moving Ahead for Progress in the 21st Century Act” and increase the maximum penalty for knowing violations from $55,000 to $75,000, or $175,000 if the violation “results in death, serious illness, or severe injury to any person or substantial destruction of property.” Minimum penalties are rescinded, with the exception of a $450 penalty for training violations.
