On 2 August 2018 the Italian Communications Regulatory Authority (Autorità per le Garanzie nelle Comunicazioni - AGCOM) published a resolution (so-called 'Free Modem Resolution') to further implement the provisions contained in EU Regulation No. 2015/2120, in relation to the prohibition to restrict the use of terminal equipment connecting to a public switched network. The resolution sets out a full liberalization of the terminal equipment that end users may utilize in order to connect to the Internet and is mainly directed towards network operators and Internet access providers. The operators will have to implement the corrective measures to comply with the resolution within a scaled timeframe of 30-90-120 days from the publication date, depending on the relevant measures. The corrective measures consist in, among others, new obligations on the operators which vary from new user protection measures to specific terms and conditions of commercial offers that include the provision of terminal equipment.
