On 17 November 2010 the Council announced that it had adopted, without debate, the proposed regulation establishing the European Securities and Markets Authority. Only minor and technical drafting amendments have been made to the text adopted by the European Parliament on 22 September 2010 and agreed by the Commission on the same date. The Council also adopted, without debate, the proposed directive amending existing legislation in respect of the powers conferred on certain new European supervisory authorities, including ESMA, adopted by Parliament on 22 September (the Omnibus I Directive). Once the legislation has been signed by the signatories of the relevant institutions, it will be published in the Official Journal and will come into force twenty days after that publication. The regulation will apply in member states from 1 January 2011 (other than certain transitional provisions which will apply from the date of entry into force) and the relevant provisions of the directive must be implemented by Member States by 31 December 2011. ESMA will be established on 1 January 2011.
