The government has published draft regulations, due to come into force on 6 April 2010, relating to additional paternity leave and pay. The regulations will allow families to share leave for the purposes of caring for a child by allowing fathers or partners of mothers or adopters the right to take up to six months' additional leave to care for a child, if the child's mother or the primary adopter returns to work before the end of their full maternity or adoption leave entitlement. It will apply in relation to children due or placed for adoption on or after 3 April 2011. Where the mother or primary adopter returns to work before their statutory maternity or adoption pay has been exhausted, eligible employees will be entitled to receive additional statutory paternity pay for the remainder of the period it would have been paid.
