On September 26th, the SEC and CFTC reopened the comment period for their study on whether stable value contracts should be considered swaps. The study is required by Section 719(d) of the Dodd-Frank Act. The original comment period for the study closed on September 26, 2011. The SEC and CFTC did not complete the study pending adoption of final rules further defining the terms "swap" and "security-based swap." The SEC and CFTC are considering the study in light of the recent adoption of those final rules. Comments should be submitted within 30 days after publication in the Federal Register, which is expected during the week of October 1. SEC Release No. 34-67927.
