On 9 September 2011, the General Court dismissed appeals by Deltafina and Alliance One regarding the fines imposed on the companies by the Commission for their participation in the Italian raw tobacco cartel. The General Court held that in order to benefit from whistleblowing under the Leniency Notice 2002 an entity must co-operate with the Commission throughout the whole process. Deltafina had revealed the existence of its application for leniency to other cartel members before the Commission’s investigation had been carried out thereby breaching the continuing co-operation requirement and losing its immunity.
