In a consent decree approved by a federal court in California on February 8, 2011, EPA agreed to finalize nonattainment designations for the 1997 national ambient air quality standards (NAAQS) for fine particulates (PM-2.5) and ground-level ozone for the Los Angeles basin. NRDC v. EPA, No. 106029 (C.D. Cal. approved 2/8/11). The agreement resolves a 2010 lawsuit by environmental groups alleging that EPA had failed to take final action on California’s state implementation plan (SIP) and the South Coast Air Quality Management District’s portion of the SIP. Under the agreement, EPA must finalize the PM-2.5 standard by September 30 and the ozone standard by December 15. EPA announced the proposed settlement on December 23, 2010, and the 30-day public comment period ended January 24.
